Terms of Service
Rules for using SecureVisit’s family portal, resident portal, staff console, and related services
Effective date: [Month Day, Year] | Last updated: November 8, 2026
These Terms of Service (“Terms”) are between you and [Company Legal Name] (“SecureVisit,” “we,” “us,” or “our”). They apply when you access or use SecureVisit’s websites, family portal, resident portal, staff console, messaging, video visit features, payment functions, and related support (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
A correctional facility may have a separate agreement with SecureVisit and may set additional rules for use at that facility. Those rules control facility access, approvals, schedules, monitoring, and conduct on facility systems. These Terms do not override facility rules or applicable law.
1. Eligibility and accounts
You must be legally able to agree to these Terms and meet any age and facility eligibility requirements shown in the Services. If you are under the age of majority where you live, you may use the Services only with permission and supervision of a parent or legal guardian, and only if the facility permits it. [Confirm minimum age and whether minor accounts are allowed before publication]
You agree to provide accurate account information, keep it current, protect your login credentials, and promptly report suspected unauthorized access to [Support email: to be confirmed]. You are responsible for activity under your account unless the law provides otherwise.
A facility may approve, deny, suspend, or revoke access to a resident or facility. SecureVisit may require identity or eligibility verification and may limit features based on facility settings.
2. The Services and facility decisions
SecureVisit provides technology for approved users to communicate and for facilities to administer those functions. Available features may include messaging, video visits, account management, and payments. Features can vary by facility and may change, be unavailable, or be suspended for maintenance, security, operational, or legal reasons.
The facility, not SecureVisit, makes decisions about resident eligibility, approved contacts, visit availability, facility rules, moderation, and access to facility systems. Contact the facility about approvals, schedules, restrictions, or facility decisions.
SecureVisit is not an emergency service. Do not rely on the Services to contact emergency responders or to report an urgent safety concern. Use the emergency or reporting process provided by the facility or local authorities.
3. Communications and facility review
Communications through the Services may be monitored, reviewed, recorded, retained, or restricted by a facility, as permitted by law and the facility’s rules. You should not assume that messages or video visits are private or confidential. Any recording or monitoring notice shown in the Service or by the facility applies to that feature.
You are responsible for ensuring that you have the right to send content and that your use complies with facility rules and law. SecureVisit does not provide legal advice and does not determine whether communications are privileged.
4. Acceptable use
You may use the Services only for lawful, authorized purposes. You agree not to:
- break the law, violate facility rules, or interfere with facility operations or another person’s safety;
- use the Services to threaten, harass, exploit, defraud, impersonate, or unlawfully surveil another person;
- send content that is unlawful, abusive, threatening, or otherwise prohibited by facility policy;
- bypass security, identity checks, access limits, account restrictions, or payment controls;
- access another person’s account or data without authorization, probe or disrupt systems, introduce malware, or attempt to reverse engineer the Services except where law prohibits that restriction;
- use automated means to scrape, copy, or overload the Services, or use the Services to build a competing service without our written permission.
5. User content
You retain rights you have in messages, images, or other material you submit (“User Content”). You grant SecureVisit a limited, non-exclusive license to host, process, transmit, display, and make User Content available as needed to operate, secure, support, and improve the Services, and as directed by the facility or required by law. This license ends when the content is deleted from active systems, subject to facility instructions, legal obligations, backups, and retention rules.
You authorize the facility and its authorized personnel to access User Content as described in the facility’s rules, the Privacy Policy, and applicable law. You represent that you have the rights and permissions needed to submit the content and grant this license.
6. Payments, fees, and refunds
Some features may require payment. Before you pay, the Services or facility will show the price, applicable fees, and payment terms. Payments may be processed by a third-party provider under its own terms. You authorize the payment method you select to be charged for the amount shown.
Fees, credits, refunds, and disputes may be governed by facility rules and the payment provider’s terms. [Insert the actual fee, cancellation, refund, chargeback, and stored-value policy. Do not publish until the payment flow and responsibilities are verified] Contact [billing email] for SecureVisit billing questions; contact the facility for facility-imposed fees or eligibility decisions.
7. Third-party services
The Services may link to or rely on third-party services, including hosting, communications, identity verification, and payment providers. Those services may have separate terms and privacy notices. SecureVisit is not responsible for third-party services it does not control, except as required by law or contract.
8. Suspension and termination
You may stop using the Services at any time. Family accounts can also be deleted; see Delete your account. We or a facility may suspend, restrict, or terminate access when needed to enforce these Terms or facility rules, protect safety or security, comply with law, address misuse, or discontinue a feature. Where appropriate and permitted, we will provide notice or an opportunity to correct the issue.
When access ends, your right to use the affected Services ends. Information may remain in facility or SecureVisit records as described in the Privacy Policy, facility agreements, and applicable retention schedules.
9. Service availability and changes
We work to keep the Services available, but we do not promise uninterrupted or error-free operation. We may update, suspend, or discontinue all or part of the Services. We will provide notice of material changes where required by law or contract.
10. Disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” SecureVisit disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a communication will be delivered, that facility access will be approved, or that the Services will meet every user or facility requirement.
Nothing in these Terms limits a right or remedy that cannot lawfully be limited.
11. Limitation of liability
To the extent permitted by law, SecureVisit and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to the Services or these Terms.
To the extent permitted by law, SecureVisit’s total liability for claims arising out of or relating to the Services or these Terms will not exceed [Insert a counsel-reviewed cap, such as the amount paid to SecureVisit for the affected Services in the 12 months before the event, or another lawful amount]. This limit does not apply where the law prohibits it.
12. Indemnity
[Counsel to determine whether and how an indemnity is appropriate for consumer users and facility users. If retained: You agree, to the extent permitted by law, to indemnify SecureVisit against third-party claims arising from your unlawful use of the Services or violation of these Terms, except to the extent caused by SecureVisit’s negligence, misconduct, or breach of law]
13. Governing law and disputes
These Terms are governed by the laws of [State], without regard to conflict-of-law rules, except where consumer protection laws require otherwise. The courts located in [County and State] will have jurisdiction over disputes, subject to any non-waivable rights you have under applicable law.
[Counsel to confirm whether to include arbitration, class-action waiver, venue, or a different dispute process. None is added in this draft]
14. Changes to these Terms
We may update these Terms as the Services or legal requirements change. We will post the updated Terms with a new “Last updated” date. If a change materially affects your rights, we will provide additional notice where required. Continued use after the effective date of updated Terms means you accept them, except where the law requires another form of consent.
15. General terms
If a court finds part of these Terms unenforceable, the remaining provisions will remain in effect to the extent allowed by law. You may not assign your rights under these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or transfer of the Services. These Terms, together with any applicable facility-specific notice or terms, describe the agreement for your use of the Services. If these Terms conflict with facility rules about access or on-site conduct, the facility rules control those matters.
